The short version: TradingPal is a charting and analysis tool, not an investment adviser. Nothing on this site is a recommendation to buy or sell anything. Trading is risky, you can lose money, and every trading decision you make is yours alone. If you use TradingPal, you agree you cannot hold us responsible for your trading results.
These Terms of Service (the “Terms”) are a binding agreement between you and TradingPal (“TradingPal”, “we”, “us”, or “our”), the operator of tradingpal.io and related services (together, the “Service”). By accessing or using the Service, creating an account, or purchasing a subscription, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and legally capable of entering into a contract to use the Service.
TradingPal is a software tool that displays market charts and runs automated algorithms over historical price data to draw trendlines, detect chart patterns, screen stocks, and compute statistics such as historical win rates and risk/reward figures. Everything the Service shows you — trendlines, support and resistance levels, pattern detections, screener results, alerts, backtest records, price targets, stops, and any other output (collectively, “Content”) — is generated automatically from historical data, for informational and educational purposes only.
TradingPal is not:
Nothing in the Service constitutes investment advice or a recommendation, solicitation, or offer to buy or sell any security, derivative, or other financial instrument, or to pursue any trading strategy. Content is not tailored to your financial situation, objectives, or risk tolerance, and no Content should be understood as a statement that any security or strategy is suitable for you.
No fiduciary, advisory, or professional relationship is created by your use of the Service. Before making any financial decision, you should do your own research and consult a licensed financial adviser. You are solely responsible for evaluating the merits and risks of any use you make of the Content, and for every trading and investment decision you make.
Trading and investing in securities involves substantial risk of loss and is not suitable for everyone. Prices can move rapidly and unpredictably. You may lose some or all of the money you invest, and if you trade on margin or with derivatives, you may lose more than your initial investment. Technical analysis — including trendlines, support and resistance levels, and chart patterns — is inherently subjective and probabilistic; a detected pattern or level is never a guarantee of future price behavior. You accept full responsibility for all trading losses, costs, and consequences of acting on anything you see in the Service.
Statistics displayed in the Service — including win rates, expected or realized R-multiples, percentage moves, drawdowns, and per-pattern track records — are derived from automated backtests over historical data. They are hypothetical performance figures, not the results of real trading. Hypothetical performance has inherent limitations: it is prepared with the benefit of hindsight, does not reflect slippage, commissions, liquidity, taxes, or the difficulty of executing a strategy in real time, and frequently differs sharply from results achieved with real money. Past performance, whether real or backtested, is not indicative of future results. No representation is made that any account will or is likely to achieve results similar to any figure shown in the Service.
Market data shown in the Service comes from third-party sources and may be delayed, incomplete, or inaccurate. Algorithmic output can contain errors. We do not warrant the accuracy, completeness, timeliness, or reliability of any data or Content, and we are not liable for any errors, omissions, delays, or interruptions in it, or for any action you take in reliance on it. The Service may be unavailable from time to time without notice.
You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us promptly at info@tradingpal.io if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
Parts of the Service require a paid subscription. Subscriptions are billed in advance on a recurring basis (monthly or annual) through our payment processor, Stripe, and renew automatically until canceled. You can cancel at any time through your account or the customer portal; cancellation stops future renewals, and your subscription remains active through the end of the period already paid. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial subscription periods. We may change subscription prices with reasonable advance notice; changes apply from your next renewal.
You agree not to:
The Service and all Content, software, algorithms, designs, and trademarks in it are owned by TradingPal or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use in accordance with these Terms. No other rights are granted.
The Service integrates third-party services, including Stripe for payments and Google for sign-in and analytics. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. Links to third-party websites are provided for convenience only and do not imply endorsement.
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT, SIGNAL, PATTERN, STATISTIC, OR OTHER OUTPUT IS ACCURATE, COMPLETE, OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADINGPAL AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, INVESTMENT LOSSES, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless TradingPal and its owners, officers, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, your trading or investment decisions, your violation of these Terms, or your violation of any law or the rights of any third party.
Please read this section carefully — it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Judgment on the award may be entered in any court of competent jurisdiction. Either party may instead bring an individual claim in small-claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.
You and TradingPal each waive the right to a jury trial and the right to participate in a class action, class arbitration, or other representative proceeding. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court. You may opt out of this arbitration agreement by emailing info@tradingpal.io within 30 days of first accepting these Terms, with your name and account email.
These Terms are governed by the laws of the State of New York, U.S.A., without regard to its conflict-of-laws rules. Subject to Section 15, any judicial proceeding will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction.
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; the “Last updated” date above reflects the latest version. Material changes will be communicated through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
You may stop using the Service or delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Sections that by their nature should survive termination (including Sections 3–5 and 12–16) survive.
These Terms, together with the Privacy Policy, are the entire agreement between you and TradingPal regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, sale, or reorganization.
